8. Section 60 Notice and 61 Prior Consent

The Control of Pollution Act 1974 enables a local authority to serve a notice on a person (this includes a company) who is carrying out, or who are planning to carry out, works of construction, demolition, road-works, railway maintenance etc. in order to control the noise from those operations. This is called a Section 60 Notice.

The act also enables such a person to apply to the local authority for prior consent in respect of such works, this is called a Section 61 Prior Consent.

The application must contain particulars of (a) the works to be carried out and (b) the steps proposed to be taken to minimise noise resulting from the works. The prior Consent application must be provided to the Environmental Protection Team at the Council at least 28 days before any works commence.

The consent (if given) may include specific and often detail bespoke conditions.

For more information to discuss your proposed works and see if a Section 61 Prior Consent is relevant please email the Environmental Protection Team on environmental.protection@reigate-banstead.gov.uk.

We have a specific detailed application form that we can provide upon request via the email address above.
