2. Guidance for Applicants (CIL)

The Council has prepared guidance notes, and a process diagram, to assist those making planning applications in understanding how CIL might apply to their development proposals, and to understand the process of charging and collecting the levy.  These can be downloaded below.

Additional guidance is available on the government' planning practice guidance - Gov.UK, website and all forms relevant to CIL can be found on the Planning Portal website.

For further information or queries about CIL for developments in Reigate & Banstead, please email CIL@reigate-banstead.gov.uk

Is my development liable for CIL?

The Council's CIL charging schedule includes charges for residential and convenience retail uses only.  In general, your development is therefore likely to be liable for CIL if it:

  • creates a new dwelling(s)
  • creates 100 square metres or more of new build residential or convenience retail floorspace
  • involves the conversion/ change of use of a building(s) to residential use and the building has not been used for a continuous period of at least 6 months in the last three years

CIL applies to most forms of planning application and, in some cases, may apply to development undertaken through general consent (i.e. permitted development).

All applicants must submit a completed version of the CIL Additional Information Form (available on the website, Planning Portal website) alongside their application. This form ensures that we have sufficient information to determine whether your development is liable and to accurately calculate any charges due. It is therefore important that it is completed fully and accurately.

How much will I have to pay?

CIL takes the form of a charge on each square metre of additional floorspace created. The charge to be applied depends on the type and location of the development as set out in our page, Council's Charging Schedule.

For residential developments, you can find out which Charging Zone your development falls into by using our 'Where I Live' feature. The Charge Zones can be found in the My Maps tab under the Planning Category.

You can also use our CIL calculator to help you estimate the potential CIL liability for a development. Please note: this is an indicative calculation and does not constitute a formal determination or notification of CIL liability by the Council. (Please note this calculator does not include indexation) As CIL is non-negotiable, applicants are strongly encouraged to familiarise themselves with likely CIL liabilities when making offers to purchase land.

For some types of development it may be possible to claim relief from CIL. Information about the types of relief available in Reigate & Banstead is set out in the Council's CIL guidance notes for applicants (PDF). Forms for applying for relief are available on the website, Planning Portal website.
