Information for operators

This page is intended for current operations of installations that are permitted by us to provide some useful information to ensure continued compliance with the permitting regulation.

  • Please read and understand your permit. If you are unsure on any of the requirements of your permit please contact us and we are more than happy to discuss and provide advice. Failure to comply with the conditions of your permit is deemed an offence under the Permitting regulations which could result in enforcement action and it could jeopardise your permit also.
  • Some permits will require the operators to keep, maintain and supply information and records to the council. Please ensure you put key dates in your diaries so you don’t fail to provide information required to us.  Failure to supply required information on time could jeopardise your permit, your risk rating could go up, which will effectively affect you financially and potentially we may need to take enforcement action as a last resort.
  • If you sell your business to someone else or the business that holds the permit changes its name, then the current permit is likely no longer valid.
  • If you operate a permitted installation without the correct permit this is an offence under the permitting regulations. Therefore, any ownership changes should be reported as soon as you are aware to the council, so we can advise on what is required to ensure your continued compliance. 
  • Petrol filling stations only - during site inspections we often identify broken ‘O’ rings on fill points which result in us being unable to record satisfactory compliance. Please ensure the ‘O’ rings are regularly checked, and a spare is kept on site so you are able to replace when they are worn or broken.

Enforcement

The Council has legal duties to comply with in relation to the Permitting Regulations.  Where possible, and in accordance with our Enforcement Policy, we will aim to work with operators to address any compliance issues that may occur. Depending on the nature of any offences that occur the council has the following enforcement based options at its disposal.

  • Service of an Enforcement Notice
  • Suspension of a Permit
  • Revoke a permit
  • Prosecution in a Court Of Law
