Dropped kerb enforcement
A Penalty Charge Notice can now be issued to a vehicle parked across a dropped kerb
New powers under the Traffic Management Act 2004 enable the Council's Civil Enforcement Officers (Parking) to issue a Penalty Charge Notice to a vehicle parked across a dropped kerb.
At present Surrey County Council (Highway Authority) has asked the Borough Council not to issue Penalty Charge Notices in these situations until the Department of Transport and its lawyers have decided whether or not the restriction needs to be signed. This decision is expected to be made in the summer 2008.
However, once this issue has been resolved enforcement of dropped kerbs will only be carried out along very strict guidelines.
- Penalty Charge Notices will only be issued to persistent offenders and only at the request of the householder or resident. This will enable residents and their visitors to park across their own dropped kerbs without fear of receiving a ticket.
- enforcement of shared driveways will not be undertaken to avoid escalating neighbour disputes.
