Hiring contractors

Hiring contractors

This section provides information on the Council’s policy towards protecting its staff on occasions when we hire contractors.

From time to time the Council hires contractors to carry out tasks which may up to that point be performed by our own staff.

In order to protect our staff on those occasions, we make it a condition of the contract that the contractors will employ our staff on the same terms and with access to a broadly comparable pension scheme.

This arrangement is in accordance with TUPE, the Transfer of Undertakings (Protection of Employment) Regulations.

The Council has adopted the Office of the Deputy Prime Minister’s Code of Practice on Workforce Matters in Local Authority and refers to it in contracts.

No contracts involving the transfer of Council staff have been awarded within the past 12 months.

Reigate and Banstead Borough Council is committed to complying with this code in the event of any transfer of staff to any other employing organisation(s). There have been no relevant transfers during 2005/06.
