Significant harm and contaminated land

The existence of a pollutant linkage alone does not make land contaminated land. The effect of the substances must be that significant harm is caused or there is significant possibility of such harm being caused; or there is pollution of controlled waters.
The meaning of “significant harm” or “significant possibility” is explained in the statutory guidance. In determining whether a matter falls within one of the categories of significant harm or significant possibility then reference must also be had to various other scientific and statistical processes and documents that are not contained within the statutory guidance.
