Licensing Policy Review

This page asks for your comments on our review of our Licensing Policy which is due to come into effect in December 2010.

The Policy sets out our approach to licensing in the borough. It gives clear guidance to licence holders, applicants and people who may comment on licence applications, or seek reviews of our policies and expectations. We are legally obliged to have regard to our Policy when we make decisions on licence applications or reviews. If any of our decisions are appealed against, then the Magistrates, who hear the appeal, must also consider the contents of the Policy.

Section 5 of the Licensing Act 2003 requires us to review our licensing policy every three years.

Proposed amendments to the Policy

Our current Policy is informative, concise and has not been subject to legal challenge and it is therefore proposed that the format should be retained. However as a result of new and amended legislation the following areas have been included in the draft:

  • new mandatory codes introduced by the Policing and Crime Act 2009  (page 5)

  • extended definition of Interested Parties to include Elected members (page 6)

  • new minor variation process (page 8)

  • tables and chairs outside premises following the Health Act 2006 and the smoking ban taking effect (page 8)

  • adult entertainment (page 13).

The closing date for comments on this consultation is Friday 17 September 2010

Final version due in January 2011

We will publish a summary of the consultation responses along with officer comments and appropriate amendments in the Executive agenda on 11 November 2010. This Committee will consider whether the draft Policy should be amended or approved and make recommendations on this to full Council on 9 December 2010. A final version of the Policy will be published by January 2011.
